EACH WINNER MAY BE REQUIRED TO EXECUTE PRIZE ACCEPTANCE DOCUMENTS WITHIN THE TIMEFRAME SPECIFIED BY SPONSOR, AS MORE FULLY DETAILED BELOW.

 

BY ENTERING THE SWEEPSTAKES YOU AGREE TO THESE OFFICIAL RULES, WHICH ARE A CONTRACT, SO READ THEM CAREFULLY BEFORE ENTERING. WITHOUT LIMITATION, THIS CONTRACT INCLUDES INDEMNITIES TO THE SPONSOR FROM YOU AND A LIMITATION OF YOUR RIGHTS AND REMEDIES.

 

 

1.  TO ENTER AND PLAY:  The “Unsung FANtastic Challenge Sweepstakes” ("Sweepstakes") begins at 12:00:00 a.m.  Eastern Time ("ET") on January 23, 2013 and ends at 11:59:59 p.m. ET on March 25, 2013 (the "Sweepstakes Period"). The Sweepstakes Period consists of nine (9) separate "Entry Periods", which are detailed below.  In each Entry Period you may enter the Sweepstakes online by visiting www.tvone.tv/unsungfan (the “Website”) and following all on-screen links and instructions: (i) to complete the online entry form in its entirety, including, by entering your full legal name, complete address, phone number (including area code), e-mail address and date of birth; (ii) to select your answer to the weekly trivia question for the corresponding Entry Period; and (iii) to submit your entry form. Your answers to the weekly questions do not need to be correct to obtain an entry and will not affect your chances of winning this Sweepstakes.  A link to Sweepstakes registration will also be available on the websites of the following radio stations:  WAMJ/WUMJ-FM–majicatl.com; WWIN-FM–magicbaltimore.com; WNOW-FM–oldschool1053.com; WZAK-FM–wzakcleveland.com; WXMG-FM–mycolumbusmagic.com; WDMK-FM–kissdetroit.com; KMJQ-FM–myhoustonmajic.com; WTLC-FM–tlcnaptown.com; WRNB-FM–rnbphilly.com; WFXC-FM–foxync.com; WKJM/WKJS-FM–kissrichmond.com; WFUN-FM–oldschool955.com; WMMJ-FM–mymajicdc.com; and KSOC-FM–oldschool945.com.  All entries must be received by the end time and date (detailed below) of each respective Entry Period to be eligible for that week’s Sweepstakes drawing. Entries from one Entry Period will not carry over to subsequent Entry Periods. The Sponsor’s (as defined in Section 10 below) database clock is the official clock for this Sweepstakes. For purposes of this Sweepstakes, an entry is “received” when the Website’s servers record the entry information. Proof of sending (such as, without limitation, a printed, saved or copied automated receipt confirming entry, a “thanks for entering” screen or message) does not constitute proof of actual receipt of an entry for purposes of this Sweepstakes.

Limit one (1) entry per person/per email address/per household/per day during each Entry Period.  Entries that are forged, altered, mechanically reproduced multiple entries or multiple entries submitted by means of software-generated or other automated processes are not valid for entry and will be disqualified and void.  Incomplete, lost, late, misdirected, illegitimate, mutilated, garbled and illegible entries will be disqualified and void.  Entries using macro, robotic, script, or other forms of automatic entry will be disqualified and void.  Also, entries made by anyone other than the entrant and/or originating at any other web site or e-mail address, including, without limitation, commercial sweepstakes subscription notification and/or entering service sites, will be disqualified and void.  Any questions regarding the number of entries submitted or the owner of an email account shall be determined by Sponsor in its sole discretion.  Entries become the exclusive property of Sponsor and will not be acknowledged or returned. As a condition of entering the Sweepstakes, each entrant gives consent for Sponsor to obtain and deliver his or her name, address and other information to third parties for the purpose of administering this Sweepstakes and complying with applicable laws, regulations and rules.  Any attempt made to submit entries in excess of any limit or otherwise in violation of these Official Rules by using multiple or false contact information or otherwise may be disqualified. 

2.  ELGIBILITY: Sweepstakes is open only to legal residents of the forty-eight (48) contiguous United States (U.S.)  and the District of Columbia (Excluding Alaska and Hawaii), who are twenty-one (21) years of age or older at the time of entry and have a valid U.S. Passport.  Travel guest of Grand Prize Winner must also be a legal resident of the U.S who is twenty-one (21) years of age or older and have a valid U.S. Passport. All federal, state and local laws and regulations apply.  Void where prohibited by law.  Sweepstakes is not open to employees of Sponsors, or each of their respective parents, affiliates and subsidiary companies, and their advertising or promotional agencies ("Sweepstakes Entities"), and the immediate family members of and any persons domiciled with, such employees. For purposes of this Sweepstakes, "immediate family members" is defined as spouse, partner, parent, legal guardian, in-law, grandparent, sibling, children and grandchildren.

3.  PRIZES:  One (1) prize will be awarded in each Entry Period, for a total of nine (9) prizes.

Entry Periods 1-8: Each Winner will be awarded one (1) One Thousand Dollar ($1,000) Visa® gift card (“Weekly Prize”).  Gift cards are subject to terms and conditions specified by issuer. Visa is not a participant in or sponsor of this Sweepstakes. Approximate retail value (“ARV”) of each Weekly Prize: One Thousand Dollars ($1000).

Entry Period 9: Winner will be awarded a trip for Winner and one (1) guest to the One Love Getaway in Nassau, Bahamas (“Grand Prize”) to include:

•       Round-trip, economy airfare from the metropolitan airport nearest to the Winner’s primary residence and returning to the metropolitan airport nearest to the Winner’s primary residence;

•       One (1) room  hotel accommodations for four (4) days/three (3) nights in a four (4) star resort (inclusive of hotel tax, resort fee and service charges);

•       Three (3) breakfast vouchers;

•       Five (5) Twenty-Five Dollar ($25) meal vouchers for lunch/dinner ( One Hundred Twenty-Five Dollars ($125) total);

•       Roundtrip airport transfers between Nassau International Airport and the resort; and

•       Access to all Radio One gospel concerts, comedy shows, celebrity autograph signings, worship services, relationship seminars, fitness classes, bible study classes and other activities sponsored by Radio One.

The Grand Prize trip does not include: ground transportation, transfers (except as noted), optional excursions, meals (except as noted), beverages, hotel room service, gratuities, casino gambling, luggage fees, telephone calls, photographs, Internet service, any purchases made during the trip, or items of a personal nature such as medical services, massages, spa treatments, laundry, hair styling or manicures, all of which are the responsibility of the Winner and his or her guest. Trip dates: 5/2/13 -5/5/13.

ARV of the Grand Prize:  Two Thousand Five Hundred Dollars ($2,500). The ARV may vary based on airfare fluctuations, distance between departure and destination and other reasons.  Sponsor is not responsible for and Winner will not receive difference between actual retail value and the ARV stated in these Official Rules or in any Sweepstakes-related correspondence or materials.  Additional restrictions may apply. Additional prize details not specified in these Official Rules will be determined in Sponsor’s sole discretion. 

Hereinafter the Weekly Prize and Grand Prize may be collectively referred to as “Prize.” Total ARV of all Prizes: Ten Thousand Five Hundred Dollars ($10,500). 

Grand Prize Winner and his/her guest must travel from a Sponsor-selected airport near the Winner’s residence within the United States on Sponsor-selected dates or the Prize may be forfeited and an alternate randomly selected winner chosen. Failure to complete the trip, or utilize any portion of any Prize, does not relieve the Winner of his/her tax obligations associated with winning the Prize. Specific travel arrangements and all Prize details not specified herein will be made and determined in Sponsor’s sole discretion. All transportation tickets are subject to the terms and conditions specified thereon. Each Winner may be required to provide a credit card at time of check-in to cover incidentals incurred during the trip.  Sponsor will only provide roundtrip airfare from airport nearest Winner’s residence to Nassau International Airport (“Designated Airport”).  Travel must originate from and end at the same airport.  Flight schedules are subject to change without notice.  Sponsor is not liable for any missed Prize events or opportunities or expenses incurred as a consequence of flight cancellation/delay.  It is each Winner's and his/her guest's  sole responsibility to comply with all travel requirements, which may include, without limitation, presenting the necessary identification (including photograph I.D. and passport) at the time of travel.  Once selected by winner, guest cannot be changed without the express consent of Sponsor, which may be withheld for any reason. The Grand Prize Winner and his/her guest must each possess a valid passport and valid government issued photograph identification card. The Grand Prize Winner and his/her guest must travel together on the same itinerary, including the same departure date, destination and return date. By entering this Sweepstakes and accepting the Prize, each Winner agrees to maintain his/her behavior in accordance with all applicable laws and generally accepted social practices in connection with participation in any Sweepstakes activity, including use of the Prize.  Winners understand and agree that Sponsor has the right, in its sole discretion, to disqualify and remove the Winner or his/her guest from any activity at any time if the Winner or his/her guest’s behavior at any point is disruptive or may or does cause damage to person, property or the reputation of Sponsor or otherwise violates the policies of the Prize providers, and in such a case, the winner will still be solely responsible for all taxes and other expenses related to the prize. Participants waive the right to assert as a cost of winning any prize, any and all costs of verification and redemption or travel to claim the prize and any liability and publicity which might arise from claiming or seeking to claim said prize. Prize is forfeited if Winner is unable to travel on/during designated dates/time frame

4.  ODDS: The odds of winning a Prize in each Entry Period depend on the number of eligible entries received during that Entry Period. 

5.  WINNER SELECTION AND AWARDING OF PRIZES:  All Entries received during an Entry Period will be placed in a pool for random drawing Prize selection for that Entry Period.  Limit one (1) Weekly Prize per person/per email address/per household for the entire Sweepstakes Period.  Notwithstanding the foregoing, Winners of a Weekly Prize are eligible to enter to win the Grand Prize during Entry Period 9. Winners will be selected in random drawings conducted by Sponsor's designated representative, whose decisions are final, on or about the Approximate Drawing Dates listed in Section #1, from among all eligible entries received during the corresponding Entry Period.  Entries will not carry forward to subsequent Entry Periods.  Winner may be notified by phone, email or delivery carrier in Sponsor's sole discretion within approximately three (3) days of each drawing.  Winner will be required to execute and notarize (where applicable) an affidavit of eligibility, liability release and publicity release (unless prohibited by law) and tax forms, which must be returned by the date appearing on Prize notification and will require Winner to provide his/her Social Security Number.  The guest of each Winner may also be required (in Sponsor’s sole discretion) to sign a liability/publicity release (unless prohibited by law) within the time frame specified by Sponsor.  In the event of noncompliance with this requirement, such Winner and/or guest will be refused travel and Prize may be forfeited.  All prize claims, affidavits of eligibility and liability/publicity releases are subject to verification by Sponsor.  If any prize notification or Sweepstakes communication is rejected or returned as undeliverable or if a potential Winner cannot be reached after a reasonable attempt has been made by Sponsor (as determined by Sponsor in its sole discretion), such Winner may be disqualified and an alternate Winner may be randomly selected.  All federal, state, and local taxes on prizes and expenses not specified are the sole responsibility of the Winner(s).  All meals, gratuities, in-room charges, travel expenses, transfers, taxes, ground transportation and other expenses not specified herein are the sole responsibility of the Winner.  No more than the stated number of prizes will be awarded.  All Prizes legitimately claimed will be awarded.  No transfers, prize substitutions or cash redemptions will be made, except at Sponsor’s sole discretion.  Sponsor reserves the right to substitute the stated prize with another prize of equal of greater value for any reason, including, without limitation, due to prize unavailability.  No payment or any other consideration is required for Winner to redeem or obtain the Prize.

By entering the Sweepstakes, (except where prohibited by law) each entrant agrees that Sponsor and its promotional partners and third party marketing entities may use the entrant’s name, picture, likeness, voice, biographical data, and/or any information contained in his/her entry in advertising, promotion, and marketing materials throughout the world, including on the internet, without additional compensation, notice, review, or approval. 

Prize is non-transferable or assignable.  No substitution is permitted, except by Sponsor, who reserves the right, in its sole discretion, to substitute the Prize for one of equal or greater value.  Dates and times of concerts, events, and activities promoted by event sponsors are subject to change and those changes are deemed to be beyond the control of Sponsor.  Changes of venue, cancellation of engagements by performing artists, and/or their management may be permanent in nature.  Sponsor is not obligated to make any effort to find an alternative prize under these circumstances. If a Winner cannot or will not accept the Prize as stated, the Prize may be awarded to an alternate randomly-selected Winner. 

In the event any winner is found to be in violation of these Official Rules or is otherwise determined by Sponsor in its sole discretion to be ineligible, he/she will be required to forfeit the prize or to reimburse Sponsor for the stated value of the prize if such a violation is found after the prize has been used by the winner.

Any person winning over Six Hundred Dollars ($600) in prizes will receive an IRS form 1099 at the end of the calendar year for tax purposes and a copy of such form will be filed with the IRS as required by law.

By participating in the Sweepstakes, entrant fully and unconditionally agrees to and accepts these Official Rules and the decisions of the Sponsor and/or Administrator, which are final and binding in all matters related to the Sweepstakes, including interpretation of these Official Rules and awarding of the prizes. 

6.  GENERAL PROVISIONS:  All participants agree to not damage or cause interruption of the Sweepstakes and/or prevent others from participating in the Sweepstakes.  Failure to comply with these Official Rules may result in disqualification from this Sweepstakes.  Sponsor reserves the right, in its sole discretion, to permanently disqualify any person it believes has intentionally violated these Official Rules or has attempted to tamper with or impair the administration, security, fairness or proper play of the Sweepstakes or has engaged in behavior that Sponsor deems obnoxious, inappropriate, threatening, illegal or that is intended to annoy, abuse, threaten or harass any other person, even if the disqualified winner or potential winner may have been notified or displayed or announced anywhere.  If the Sweepstakes is not capable of running as planned for any reason, Sponsor reserves the right, in its sole discretion, to cancel, modify or suspend the Sweepstakes and to award the prize(s) from eligible entries received prior to cancellation, modification, or suspension or as otherwise deemed fair and appropriate by Sponsor.  Any person who supplies false information, obtains entries by fraudulent means, or is otherwise determined to be in violation of these Official Rules in an attempt to obtain any prize will forfeit any prize won and may be prosecuted to the full extent of the law.  In the event the Sweepstakes is compromised by a virus, non-authorized human intervention, tampering or other cause beyond the reasonable control of Sponsor that corrupts or impairs the administration, security, fairness or proper operation of the Sweepstakes, Sponsor reserves the right in its sole discretion to suspend, modify or terminate the Sweepstakes.  Should the Sweepstakes be terminated prior to the stated expiration date, Sponsor reserves the right to award Prizes based on the entries received before the termination date.  Sponsor reserves the right to disqualify any entries by persons determined to be tampering with or abusing any aspect of the Sweepstakes. Participants further agree to not damage or cause interruption of the Sweepstakes and/or prevent others from using the Sweepstakes. Sponsor reserves the right to restrict or void online entries or participation from any IP address if any suspicious entry and/or participation is detected.   Sponsor’s failure to or decision not to enforce any provision in these Official Rules will not constitute a waiver of that or any other provision.  In the event there is an alleged or actual ambiguity, discrepancy or inconsistency between disclosures or other statements contained in any Sweepstakes-related materials and/or these Official Rules (including any alleged discrepancy or inconsistency in these Official Rules), it will be resolved in Sponsor’s sole discretion.  Entrants waive any right to claim ambiguity in the Promotion or these Official Rules.  The invalidity or unenforceability of any provision of these Official Rules will not affect the validity or enforceability of any other provision.  In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Official Rules will otherwise remain in effect and will be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.

7.  INDEMNIFICATION/LIABILITY:  EACH PARTICIPANT AGREES TO RELEASE, HOLD HARMLESS AND INDEMNIFY THE SWEEPSTAKES ENTITIES, AND THE RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES AND AGENTS OF EACH FOR ANY LIABILITY WHATSOEVER FOR INJURIES, LOSSES OR DAMAGES OF ANY KIND SUSTAINED IN CONNECTION WITH THE USE, ACCEPTANCE, POSSESSION, MISUSE OR AWARDING OF THE PRIZE OR WHILE PREPARING FOR, PARTICIPATING IN AND/OR TRAVELING TO OR FROM ANY PRIZE OR SWEEPSTAKES-RELATED ACTIVITY, INCLUDING, WITHOUT LIMITATION, ANY INJURY, DAMAGE, DEATH, LOSS, OR ACCIDENT TO PERSON OR PROPERTY.  WINNER AGREES THAT THE PRIZE IS PROVIDED AS-IS WITHOUT ANY WARRANTY, REPRESENTATION, OR GUARANTEE, EXPRESS OR IMPLIED, IN FACT OR IN LAW, WHETHER NOW KNOWN OR HEREINAFTER ENACTED, RELATIVE TO THE USE OR ENJOYMENT OF THE PRIZE, INCLUDING, WITHOUT LIMITATION, ITS QUALITY, MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE.  FURTHER, NO RESPONSIBILITIES ARE ACCEPTED FOR ANY ADDITIONAL EXPENSES, OMISSIONS, DELAYS, OR RE-ROUTING RESULTING FROM ANY ACTS OF ANY GOVERNMENT OR AUTHORITY.  EACH WINNER ACKNOWLEDGES THAT HE/SHE IS SOLELY RESPONSIBLE FOR ANY ACTIONS, CLAIMS OR LIABILITIES OF HIS/HER GUEST RELATED TO ANY SWEEPSTAKES-RELATED ACTIVITY, INCLUDING, WITHOUT LIMITATION, ANY ACTIONS, CLAIMS OR LIABILITIES RELATED TO THE GUEST’S USE OF A PRIZE. 

EACH ENTRANT UNDERSTANDS AND AGREES THAT ALL RIGHTS UNDER SECTION 1542 OF THE CIVIL CODE OF CALIFORNIA AND ANY SIMILAR LAW OF ANY STATE OR TERRITORY OF THE UNITED STATES ARE HEREBY EXPRESSLY WAIVED BY HIM/HER.  SECTION 1542 READS AS FOLLOWS:

 

“CERTAIN CLAIMS NOT AFFECTED BY A GENERAL RELEASE. A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS WHICH THE CREDITOR DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE, WHICH IF KNOWN BY HIM OR HER MUST HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR.”

Sweepstakes Entities are not responsible and/or liable for any of the following, whether caused by Sponsor, the entrant, or by human error: any lost, late, incomplete, illegible, mutilated, misdirected or postage-due entries or mail; any virus, error, omission, interruption, defect or delay in transmission or communication; technical or mechanical malfunctions; interrupted or unavailable cable or satellite systems; errors, typos, or misprints in these Official Rules, in any Sweepstakes-related advertisements or other materials; failures of electronic equipment, computer hardware or software; lost or unavailable network connections, or failed, incorrect, incomplete, inaccurate, garbled or delayed electronic communications or entry information.  Sweepstakes Entities are not responsible or liable to any entrant or winner or any person claiming through such entrant or winner for failure to supply the prize or any part thereof in the event that any of the Sweepstakes activities or the Sweepstakes Entities’ operations or activities are affected, as determined by the Sponsor in its sole discretion, including, without limitation, by reason of any acts of God, any action, regulation, order or request by any governmental or quasi-governmental entity (whether or not the action, regulations, order or request proves to be invalid), equipment failure, threatened terrorist acts, terrorist acts, air raid, blackout, act of public enemy, earthquake, war (declared or undeclared), fire, flood, epidemic, explosion, unusually severe weather, hurricane, embargo, labor dispute or strike (whether legal or illegal) labor or material shortage, transportation interruption of any kind, work slow-down, civil disturbance, insurrection, riot, or any law, rule, regulation, order or other action adopted or taken by any governmental, federal, state or local government authority, or any other cause, whether or not specifically mentioned above.

Internet access is required to participate in Sweepstakes.  In the event of a dispute concerning who submitted an entry via the internet, the entry will be declared to have been made by the authorized account holder of the e-mail address submitted at time of entry, but only if that person meets all other eligibility criteria.  An authorized account holder is defined as the natural person who is assigned to an e-mail address by an internet access provider, online service provider, or other organization (e.g.  business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.  Potential Winner may be requested to provide Sponsor with proof that he or she is the authorized account holder of the e-mail address associated with the potentially winning entry.  If a dispute cannot be resolved to Sponsor’s satisfaction, the entry will be deemed ineligible.  CAUTION: ANY ATTEMPT TO DAMAGE ANY ONLINE SERVICE OR WEB SITE OR UNDERMINE THE LEGITIMATE OPERATIONS OF THE SWEEPSTAKES VIOLATES CRIMINAL AND CIVIL LAWS.  IF SUCH AN ATTEMPT IS MADE, SPONSOR MAY DISQUALIFY ANY PARTICIPANT MAKING SUCH ATTEMPT AND MAY SEEK DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW.

8.     DISPUTES/GOVERNING LAW: Except where prohibited, as a condition of participating in this Sweepstakes, each entrant agrees that any and all disputes that cannot be resolved between the entrant and any Sweepstakes Entity, claims and causes of action arising out of or connected with this Sweepstakes, or the prize awarded, or the determination of the winner must be resolved individually, without resort to any form of class action. Further, in any such dispute, under no circumstances will an entrant be permitted or entitled to obtain awards for, and hereby waives all rights to claim punitive, incidental or consequential damages, or any other damages, including attorneys’ fees, other than entrant’s actual out-pocket expenses (if any), not to exceed Two Hundred Fifty Dollars ($250), and entrant further waives all rights to have damages multiplied or increased.

 

This Sweepstakes and any dispute arising under or related thereto (whether for breach of contract, tortious conduct or otherwise) will be governed by the internal laws of the State of Maryland, without giving effect to its conflicts of law or choice of law principles or rules that would cause the application of any other state’s laws.  Any legal actions, suits or proceedings related to this Sweepstakes (whether for breach of contract, tortious conduct or otherwise) will be brought exclusively in the state or federal courts located in the state of Maryland, and each entrant accepts and submits to the personal jurisdiction of these state and federal courts with respect to any legal actions, suits or proceedings arising out of or related to this Sweepstakes.
